Truth failed, Evidence buried, Justice blindfolded … …

Federal Constitution of Malaysia, Part II - Fundamental Liberties, Article 5 states that “No person SHALL be deprived of his life or personal liberty save in accordance with law”.

Nevertheless, this Article 5 of Federal Constitution has been violated. The highest Rule of Law of Malaysia, once again, has been raped and humiliated by their very own , guardian and enforcer of the Law. A wantonly cruel act which disregard and ignore the supremacy of basic Law and human civilisation. The fundamental presumption of being innocent until proven guilty has been ravished and seems has no application in our police stations.

Even before we digest the barbarian act upon one B. Prabakar ; even before we discover the whereabouts of one Solomon who is still missing in action, our heart wrenched by the death of one Kugan Ananthan. This 22 years old youth, was detained on suspicion of being involved in robbing and stealing luxury cars. At the point of his death, he was just a mere suspect.

Selangor police chief DCP Datuk Khalid Abu Bakar, said that soon after his arrest on Jan 15 for suspected car thefts and on questioning him, police recovered a stolen Toyota Camry and a Honda Accord. He said police further recovered 13 stolen cars based on information gathered from Kugan. Khalid said the deceased was allegedly involved in several cases of car thefts in the Klang Valley and Johor.

Alleged means declared but not proved. Is Khalid trying to equate him with guilt? Who is Khalid to do that? Why is he playing the role of a judiciary? Whether you discover 15 cars or 1500 cars, the Law is still the same. Let me have the pleasure to remind you that even the punishment would not differ.

The Law would have punish Kugan up to 7 years, if he has been charged and found guilty under Section 379A for theft of a motor vehicle. Otherwise, he would have end up in prison for 10 years, if he has been charged and found guilty under Section 392 for robbery. Till his last breath, he is innocent of any charge and he is just a mere suspect. Whatever the charge and whatever the findings of the judge in the future, rest assure, it will not cost his life. Even anyone who has committed a crime, certainly it does not merit to his death unless he had committed murder or dealt with dangerous drugs.

So, WHO has taken the law into their own hands and abusing it? What a shame to know that his death occurred in police custody? Where is the integrity of our police force? Who is tampering with the evidence?

Dearest Malaysians… … the person who died is not only one Kugan. The person who died is not only a youth. The person who died is not only an Indian. The person who died is a MALAYSIAN. With him, a mother’s love died. With him, a father’s hope died. With him, the desire of a family died. With him, the trust upon our police force died. With him, the expectation of police fairness and integrity died.

Where is Kugan’s liberty to live? Where is Kugan’s constitutional right? Where is Kugan’s basic human right?
Remember, this is not magic or mere illusion. This is not sudden. You know what happen. You know the truth. You can run but you cannot hide. It is a sin.

When you look at mirror, it will remind you. When you turn to your loves one, it will remind you. When you look at your brothers, at your sisters or even your very own, beloved child, it will remind you.

The tears of a mother will haunt you. The shattered hope of a father will curse you. The love of a family will shrink u. You will not sleep peacefully.

We are not being emotional. Neither we are worked up. We are just sending a message to highlight that someone is watching you. This message is not only intended to the main culprits but to anyone who trying to conceal or cover up the whole issue.

When the truth failed, When the evidence has been buried, When the justice has been blindfolded, I have to rest my case, in the trust of Almighty. May KUGAN rest in peace!!! !!!
